Alternative Dispute Resolution Methods in the Romanian Juridical System. Training for lawyers and judges

Purpose
The project aimed to promote conflict resolution by third party assistance among lawyers and juridical researchers. The concept of mediation is seen as complementing the Romanian juridical system and not interfering into the juridical standard procedures.
Activities
- Through a series of workshops, FDC developed a case study regarding the existing "alternative" procedures into the Romanian juridical system (completed in July 1998)
- In partnership with the Canadian International Institute for Applied Negotiation (CIIAN), FDC organized in November 1998 a more comprehensive seminar to present the concept of mediation and how it is related with the juridical system of the North American continent.
Results
- Identified a procedural method supporting the use of mediation in the Romanian juridical system;Lawyers from all over the country participated into a seminar to familiarize themselves with the ADR concept and mediation process (delivered by FDC and CIIAN experts);
- Attained support from other categories of juridical practioners for the use of mediation in the juridical system and for the establishment of permanent programs of training on court related mediation
Follow-up
- 4 training sessions to introduce the concept of mediation in Romanian Courts and how it could be used, were delivered for lawyers and judges in September - November 1999, following the invitation of the Ministry of Justice, District 3 Local Court, Bucharest and the American Bar Association – CEELI project in Romania.
