The Conference “Mediation works. Little Justice Reform” organized by the Mediation Council

The National Conference of Mediators - second edition with the theme "Mediation works. Little Justice Reform "  took place in Bucharest, at Rin Grand Hotel, on the 19-20 of November 2010, event attended by facilitators across the country and representatives of several public institutions, organizations and liberal professions.
Among the guests who held speeches, there were the representative of the Ministry of Justice, Secretary of State Mrs. Lidia Barac, initiator and supporter of the Little justice reform, which emphasized the important role of mediation in terms of new legislation. The event was attended by representatives of the Superior Council of Magistrates, the Prosecutor of the High Court of Cassation and Justice, Police, Financial Guard and National Integrity Agency, magistrates, academics and representatives of liberal professions and of business field.
The discussions revealed the need of perfecting some forms of collaboration with institutions and professions represented at the event to promote mediation as a profession and an adequate understanding of what mediating as activity of public interest is, defined as such by law. The Mediation Council considers that the presence of guests from the National Union of Bars in Romania, the National Union of Public Notaries, the National Union of Insolvency Practitioners, Chamber of Tax Consultants, Technical Experts and the Arbitral Tribunal Body of the Chamber of Commerce and Industry Romania, devote more than ever, the recognition enjoyed by the profession of mediator among other professions as well as their interest towards mediation.
At the end of the event, the participants adopted a resolution supporting the Medition Council in its necessary efforts to protect the legitimacy of the mediation profession and the consumer’s interest in the mediation service under the provisions of Directive 52/2008 of the European Parliament. The Directive provides that the mediation agreement can be validated in court only if it results out of a mediation process, fact which can be proved only by its management by a qualified and trained as a mediator person. As the national supervisory authorities and regulatory framework in mediation under the laws in force, the Mediation Council has supported through its representatives in the work, a clear distinction between the profession of mediator and any other profession, providing to the mediation services consumers, the certified fact that, only authorized mediator has the necessary qualifications for driving a mediation process.
